1. Agreement to Terms

By accessing or using the Exovon Ecosystem, including but not limited to MobCode, Astrolabe, and Exovon Cloud (collectively, the "Services"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Services.

2. Description of Service

Exovon provides an End-to-End Agentic Infrastructure Ecosystem, enabling users to write, deploy, monitor, and scale applications. The Services include web-based IDEs, deployment orchestration, global edge network hosting, and analytics.

3. User Accounts and Security

You are responsible for safeguarding the password and OAuth connections that you use to access the Services. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use & Intermediary Due Diligence (Rule 3(1)(b) IT Rules, 2021)

In compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree and undertake that you shall not host, display, upload, modify, publish, transmit, store, update, or share any information or code through our Services that:

  • Belongs to another person and to which you do not have any legal right or authorization;
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or promotes money laundering or illegal gambling;
  • Is harmful to children or violates the Protection of Children from Sexual Offences (POCSO) Act, 2012;
  • Infringes any patent, trademark, copyright, trade secret, or other proprietary intellectual property rights;
  • Deceives or misleads the addressee about the origin of the message or intentionally communicates misinformation or patently false/untrue statements;
  • Impersonates another person, company, or governmental entity;
  • Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to any cognizable offense;
  • Contains software viruses, worms, Trojan horses, ransomware, or any computer code, file, or program designed to interrupt, destroy, or compromise the functionality of any computer resource;
  • Conducts unauthorized network penetration testing, distributed denial-of-service (DDoS) attacks, cryptomining, or infrastructure scraping without explicit authorization;
  • Violates any law for the time being in force in the Republic of India.

Violation of these rules will result in immediate termination of deployments, suspension of your account, and potential notification to the appropriate law enforcement or regulatory authorities (including CERT-In).

5. Intermediary Status & Notice-and-Takedown (36-Hour SLA)

Exovon operates as an Intermediary under Section 2(1)(w) and Section 79 of the Information Technology Act, 2000. We do not initiate the transmission, select the receiver of the transmission, or modify the user content contained in your application deployments. In compliance with Rule 3(1)(d) of the IT Rules 2021, upon receiving actual knowledge by way of a court order or notification by the appropriate Government agency under Section 69A of the IT Act, Exovon will disable or remove access to the specified unlawful content within 36 (thirty-six) hours. Public complaints can be lodged via our public Abuse Reporting Center or by emailing abuse@exovon.in.

6. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of Exovon Technologies and its licensors. Your code, datasets, and proprietary intellectual property deployed on Exovon Cloud remains exclusively yours.

7. Service Level Agreement (SLA) & Uptime

We target an operational 99.95%+ monthly uptime goal for live deployed user applications. Formal contractual Service Level Agreements (SLAs) and financial service credit schedules are reserved for Custom Enterprise plan agreements. Standard services are provided on an "AS IS" and "AS AVAILABLE" basis. Scheduled maintenance windows (with 48 hours advance notice), client-side application crashes, and third-party API dependencies do not count toward downtime calculations.

8. Billing & Subscriptions

Certain features of the Services, such as Starter edge hosting and advanced AI models, are billed on a subscription basis ("Subscriptions"). Our Cloud Starter plan (₹349 INR/month) and Pro plan (₹1,499 INR/month) cover Frontend Edge Hosting only. Database features are not included on standard hosting plans (Free, Starter, or Pro). You will be billed in advance on a recurring and periodic basis depending on the type of subscription plan you select. 9. Limitation of Liability and Indemnification

In no event shall Exovon Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use or alteration of your transmissions or content. You agree to defend, indemnify and hold harmless Exovon Technologies from any claims resulting from your breach of these Terms.

10. Account Termination & Statutory Retention

We may terminate or suspend your account immediately if you breach these Terms or fail to satisfy billing obligations. Upon account deletion by the user, personal code and container deployments are expunged; however, in compliance with Direction 2(v) issued by the Indian Computer Emergency Response Team (CERT-In) under Section 70B of the IT Act, subscriber registration identity records (name, email, onboarding IP, allocated subdomains) are securely archived in an encrypted compliance vault for 5 (five) years.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
